H-1B Visa

Foreign professionals, working in a specialty occupation, who have been sponsored by an employer to work in the U.S. need a H-1B visa which is a non-immigrant work visa. The H-1B visa is valid for three years and maybe extended for another three years. The employer may later sponsor the H-1B holder for a green card if they so require.

A specialty occupation is, "one that requires theoretical and practical application of a body of highly specialized knowledge to fully perform the occupation AND which requires the attainment of a bachelor's degree or higher in a specific specialty as a minimum for entry into the occupation in the United States."

The employer has to prove a need for a specialty worker as the minimum requirement for taking up the job on offer. The employee needs to have the degree or its equivalent that qualifies them for this position. The employer then needs to obtain an approved Labor Conditions Application affirming relevant wage and working conditions and a list of other conditions as well. This is followed by filing an application with the USCIS.

Each year, only 65,000 H-1B visas are issued by the USCIS. The demand for this visa is always high so it is imperative that an applicant takes a lot of care in preparing an error free H1-B visa application. Also, it is a time consuming process involving the filing of forms both with the USCIS and the Department of Labor. Making a mistake in an application means having to wait for another whole year before being able to apply again.
